These clauses set out the terms and conditions on which you make use of this Business Secrets Club subscription (“the subscription”). Please read these terms and conditions carefully. By purchasing or accessing the subscription you confirm that you have read, understood and agree to these terms and conditions in their entirety. If you do not agree to be bound by these terms and conditions, you must not purchase or use the subscription.

Intellectual Property

The Business Secrets Club name and logo are registered trademarks owned by Martha Keith. All rights including copyright and intellectual property rights for all material in the subscription is owned by Martha Keith. Any use of the subscription, its contents, images or designs (including reproduction, copying, modification or distribution) for commercial use or an attempt to pass the content off as your own is strictly prohibited. Any violations of this term, and all terms contained herein, will be legally pursued to the fullest extent permitted by law.

Sharing

You agree that your access to the subscription is non-transferable. It is prohibited to distribute, copy, forward, and/or share the subscription, its content, your password or login information with anyone else. These are unique to you. If you share your password or login with anyone who did not purchase the subscription, our system will remove you from the subscription without a refund. 

Community Guidelines

Once inside the subscription, you will be asked to accept our community guidelines. If you break these guidelines, you may be removed from the community at any time. Discrimination, harassment, or hate speech of any kind will not be tolerated.

Liability & Disclaimers

To the fullest extent permissible under applicable law, we disclaim any and all warranties of any kind, whether express or implied, in relation to the subscription. 

We endeavour to ensure all information in the subscription is correct; however, we make no warranties, whether express or implied as to its accuracy. We also do not offer any guarantees, or warranties, of any variety, regarding the subscription in any way including, but not limited to, your future growth, income, potential, profitability, or losses derived as a result of your use of the subscription. This is for informational and educational purposes only and not intended to be legal or financial advice.

We are not liable for damages of any kind related to your use of the subscription. It is provided on an “as is” and “as available” basis without any representation or endorsement made and we make no warranty that it will meet your requirements, be fully functional or reliable. While we make every effort to ensure that the site or server that makes the subscription available is free of viruses or bugs, we make no guarantee that this is the case, and we will not be liable for any damage to computer or electronic equipment that arises in connection with your use of the subscription or any loss of content or material uploaded or transmitted through the subscription.

No Guarantees

Any results, testimonials or examples mentioned by us in our marketing material or the subscription itself are examples of what type of results are possible but are not a guarantee of any specific outcome or results. Every person’s results are dependent on their participation, effort, implementation and external, situational factors that the subscription has no influence over.

Assumption of Risk

You should use your best judgment in using the information provided in the subscription, which is done at your own risk. It is your responsibility to discern the risk of using the subscription or its content. You assume responsibility for your actions, choices, or lack thereof, related to the subscription. 

Payment Terms

When you pay for the subscription, you authorise and give permission to Business Secrets Club to charge your credit, debit card or payment provider monthly for the amount owed for payment of the subscription. Card payments can be made through the payment facility provided by Stripe and Kajabi. We are committed to ensuring that your information is secure in so far as it is in our power to do so. Business Secrets Club is not responsible for the third-party merchant’s independent policies or practices. Please see our Privacy Policy for more details on the Website privacy and security. 

Refunds and cancellations

We very much hope that you will be delighted with the subscription, and we will do everything we can to ensure your satisfaction. If you want to leave the subscription, you can navigate to the settings section of your account and click ‘cancel subscription’ to stop any future payments. Because this is a digital product, we can’t refund for any previous months access already paid for. You can also contact us for help via [email protected].

Terms of Use

The subscription may be used only for lawful purposes and in a lawful manner. You agree to comply with all applicable laws, statutes and regulations regarding the subscription both from where it is bought (England) and your own country. We reserve the right to modify or withdraw this subscription or any part of it at any time.

Severance

If any part of these terms and conditions shall be deemed by any court of competent jurisdiction to be unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from these terms and conditions but shall not affect the validity and enforceability of any of the remaining parts of the terms and conditions.

Waiver

No delay or failure by us to exercise any powers, rights or remedies under these terms and conditions will operate as a waiver of them, nor will any single or partial exercise of any such powers, rights or remedies preclude any other or further exercise of them. Any waiver is only effective is it is communicated to you in writing by us, and will only apply at that point in time and in the circumstances for which it is given.

Events Beyond Our Control

We will not be held responsible for any delay or failure to comply with our obligations under these terms and conditions if the delay or failure is caused by circumstances beyond our control.

Entire Agreement

These terms and conditions onstitute the entire agreement between you and us relating to the use of this  subscription cancels and supersedes all prior representations, understandings and agreements between you and us whether verbal or written. Any changes to these terms and conditions must be in writing and signed by both parties.

Rights Of Third Parties

You may not assign or sub-contract any of your rights or obligations under these terms and conditions to any third party without our prior written consent. No third party shall be entitled to enforce any of these terms whether by virtue of the Contracts (Rights of Third Parties) Act 1999 or otherwise. We may assign, transfer or sub-contract any of our rights or obligations under these terms and conditions to any third party at our discretion.

Law and Jurisdiction

These terms and conditions shall be governed by and construed in accordance with English law. In the event of any dispute you irrevocably submit to the exclusive jurisdiction of the courts of England.

Testimonials

You grant Martha Keith and Business Secrets Club the right to share any communications, or testimonials in connection with your participation in the subscription for the purposes of promoting and marketing the subscription. You understand that you will not receive any compensation for use of your likeness or testimonial.
